Terms of Service

By creating an account, accessing, or using BehaviorPrep ("Service," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may refuse service to anyone at any time, subject to applicable law.

BehaviorPrep is a software-as-a-service platform designed to help users prepare for the Registered Behavior Technician (RBT) examination. The Service may include, without limitation: practice questions, progress tracking, an AI Tutor feature, mock exams, and related educational tools and materials.

The Service is for educational and study purposes only. It does not constitute professional, legal, or clinical advice. BehaviorPrep is not affiliated with, endorsed by, sponsored by, or associated with the Behavior Analyst Certification Board® (BACB®), the RBT examination, or any other certifying or licensing organization. Passing the RBT exam or obtaining certification is not guaranteed.

You must provide accurate, current, and complete information when you register and must update that information as needed. You are responsible for all activity that occurs under your account and for safeguarding your password and credentials. Notify us promptly at behaviorprepacademy@gmail.com if you suspect unauthorized access. You must be legally able to enter a binding contract in your jurisdiction to use paid features; where required, you confirm you meet any minimum age we specify at signup.

Paid plans are billed through Stripe (or a successor payment processor we designate). By subscribing, you authorize us and our payment partners to charge your payment method on a recurring basis according to the plan you select.

Current subscription options (prices may change with notice as described in these Terms):

• Monthly — $9.99 per month
• Quarterly — $24.99 every three (3) months
• Yearly — $59.99 per year

Unless you cancel before renewal, subscriptions automatically renew for successive periods of the same length at the then-current rate. You may cancel at any time through your account settings (or as otherwise described in the app). Taxes and fees, if applicable, are additional unless stated otherwise.

You may cancel your paid subscription at any time. Cancellation stops future renewals; you continue to have access to paid features until the end of your current billing period. We do not provide refunds for partial subscription periods or for unused time after cancellation, except where required by law.

For annual (Yearly) plans only, we may, at our sole discretion, issue a refund if you request one within seven (7) days of the initial purchase date and you have not materially used the Service in a way that would make a refund inequitable (for example, extensive completion of paid content). Refund requests should be sent to behaviorprepacademy@gmail.com.

We may offer a free tier that does not require payment. Unless we state otherwise, use of the free tier is limited to ten (10) practice questions per content domain, for a total of up to sixty (60) questions across domains. Limits, features, and availability of the free tier may change with reasonable notice.

Unless clearly marked otherwise, all questions, explanations, copy, graphics, software, branding, and other materials on or made available through the Service ("Content") are original works owned by BehaviorPrep or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and Content for your own non-commercial exam preparation. You may not copy, reproduce, distribute, publicly display, create derivative works from, sell, license, or otherwise exploit the Content except as expressly permitted in writing by us.

You agree not to:

• Scrape, crawl, harvest, or use automated means to collect data or Content from the Service;
• Reverse engineer, decompile, or attempt to derive source code or underlying models except where applicable law expressly permits;
• Share, sell, or transfer account access, or allow others to use your credentials;
• Use the Service or Content for any commercial purpose without our prior written consent;
• Circumvent technical limits, paywalls, or security measures;
• Use the Service in violation of law or in a manner that harms us, other users, or third parties.

We may suspend or terminate access for conduct that violates these Terms or threatens the integrity of the Service.

THE SERVICE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any AI-generated output will be accurate or suitable for any particular purpose. We do not guarantee exam success, certification, employment, or any particular outcome.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEHAVIORPREP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE PROHIBITED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

BehaviorPrep is not affiliated with, endorsed by, or sponsored by the BACB® or the Behavior Analyst Certification Board. References to RBT exam topics or task lists are for educational alignment only and do not imply endorsement.

We may modify these Terms from time to time. If we make material changes, we will provide notice as required by law or by posting the updated Terms and updating the effective date. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Subject to mandatory consumer protections in your jurisdiction, you agree that exclusive venue for any dispute arising out of or relating to these Terms or the Service shall be the state and federal courts located in Florida, and you consent to personal jurisdiction there.
